Terms of Service
This Terms of Service (“TOS”) is a legal agreement between you (either an individual or an entity) and Coast Mountain Technologies. By purchasing, and/or downloading, and/or using any of our SOFTWARE, you agree to be bound by the terms of this TOS.
In this TOS, we refer to the WP Full Pay payments plugin for WordPress or any of its add-ons (both Free and Commercial versions) as SOFTWARE.
GRANT OF LICENSE
Free version (“Free”)
If you are using the Free Version of SOFTWARE you are hereby licensed to make copies of the Free Version SOFTWARE as you wish; give exact copies of the original Free Version SOFTWARE to anyone; and distribute the Free Version SOFTWARE in its unmodified form via electronic means (Internet, BBS’s, Shareware distribution libraries, CD-ROMs, etc.). You may not charge any distribution fee for the copy or use of the Free Version SOFTWARE itself. You must not represent in any way that you are selling the software itself. Your distribution of the Free Version SOFTWARE will not entitle you to any compensation from Coast Mountain Technologies.
Free Version may add a watermark that links to the SOFTWARE home page. Free Version may add a time limit, i.e., all or part of the functions of the SOFTWARE may expire and stop working after a certain period of time. Free Version may also add other limits. You may not remove the limits in the Free Version.
Commercial Version (“Pro”)
After you have purchased the Commercial License for the SOFTWARE, and have received the file of the Commercial Version, you are licensed to install the SOFTWARE only into the number of website(s) corresponding to the license you purchased. You may not duplicate the SOFTWARE in whole or in part, except that you may make one copy of the SOFTWARE for backup or archival purposes. You may terminate this license at any time by destroying the original and all copies of the SOFTWARE in whatever form. You may permanently transfer all of your rights under this TOS provided you transfer all copies of the SOFTWARE (including copies of all prior versions if the SOFTWARE is an upgrade) and retain none, and the recipient agrees to the terms of this TOS. You may not redistribute, modify or resell the SOFTWARE in any way without the written permission of Coast Mountain Technologies. You may not rent, lease, or lend the SOFTWARE. You may not use the SOFTWARE in any software or application that compete with products and services of Coast Mountain Technologies.
We provide four kind of software licenses:
- Starter: You may install the SOFTWARE on 1 (one) website for your personal, educational, non-profit and commercial use. You may not redistribute the SOFTWARE in any form. This version includes support & updates for one year.
- Business: You may install the SOFTWARE on 3 (three) websites for your personal, educational, non-profit and commercial use. You may not redistribute the SOFTWARE in any form. This version includes support & updates for one year.
- Agency: You may install the SOFTWARE on unlimited websites for your personal, educational, non-profit and commercial use. You may not redistribute the SOFTWARE in any form. This version includes support & updates for one year.
- License purchased on CodeCanyon.net: You may install the SOFTWARE on one website for your personal, educational, non-profit and commercial use. You may not redistribute the SOFTWARE in any form. This license includes lifetime updates, and support for the number of months purchased during checkout.
CUSTOMER PORTAL
For licenses purchased on https://paymentsplugin.com:
- After you have purchased the Commercial License, we will create an account for you in our customer portal. You must keep your login credentials secret. You may not distribute, give away, lend or re-sell it. We reserve the right to monitor levels of your customer portal activity and take any necessary action in the event of abnormal usage being detected.
For licenses purchased on CodeCanyon.net:
- After you have purchased the Commercial License, CodeCanyon will make the SOFTWARE available for download and installation in its Download area at https://codecanyon.net/downloads .
SOFTWARE UPDATES
WordPress automatically checks for updates to its core and all installed themes and plugins. When doing update checks, the SOFTWARE plugin will connect to https://www.freemius.com (for “Starter”, “Business”, and “Agency” licenses) or https://paymentsplugin.com (for licenses purchased on CodeCanyon.net) and check for update information.
For licenses purchased on our website:
- After you have purchased the Commercial License, you will be provided with a unique license key. By entering your license key and registering the domain with the plugin, you can update the plugin in your WordPress dashboard. When registering, your domain name, the plugin name and the key will be sent to https://www.freemius.com for verification and registration.
- You must keep your license key secret. You may not distribute, give away, lend or re-sell it. We reserve the right to monitor levels of your key usage activity and take any necessary action in the event of abnormal usage being detected.
PROHIBITED USE
You may not use the SOFTWARE on website(s) and/or webpage(s) that contain inappropriate, unlawful, illegal or offensive content.
TERMINATION
Without prejudice to any other rights, Coast Mountain Technologies may terminate this TOS if you fail to comply with the terms and conditions of this TOS. In such event, you must destroy all copies of the SOFTWARE.
REFUND POLICY
For licenses purchased on our website:
- If you are not satisfied with your purchase, please contact us within 14 days, and we will give you a refund (non-refundable transaction fees of payment processors will not be refunded).
For licenses purchased on CodeCanyon.net:
- If you are not satisfied with your purchase, please contact Envato within 14 days, and we will give you a refund.
COPYRIGHT
The SOFTWARE is owned by Coast Mountain Technologies, and is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The SOFTWARE is licensed, not sold, to You for use solely subject to the terms and conditions of this Agreement.
LIMITED WARRANTY
The SOFTWARE is provided “AS IS” without warranty of any kind, either expressed or implied, including, but not limited to warranties of merchantability or fitness for particular purpose. In no event will the author or authors be liable to to you for any damages, including incidental or consequential damages, arising out of the use of the software, even if advised of the possibility of such damages. you acknowledge that you have read this license, understand it and agree to be bound by its terms as the complete and exclusive statement of the agreement between us, superseding any proposal or prior agreement, oral or written, and any other communications between us relating to the subject matter of this license.
LIMITATION OF LIABILITY
In no event shall Coast Mountain Technologies or its suppliers be liable to you for any consequential, special, incidental, or indirect damages of any kind arising out of the delivery, performance, or use of the software, even if Coast Mountain Technologies has been advised of the possibility of such damages. all legal issue should be judged by the court indicated by Coast Mountain Technologies.
DISCONTINUATION OF PRODUCTS
We reserve the rights to discontinue the SOFTWARE at any time, at our sole discretion, with or without notice to you.
STOP SERVICES
We reserve the rights to refuse or cease providing products or services to you at any time, at our sole discretion, with a 7-day written notice to you.
When we cease providing products and services to you, we refund all purchase and renewal fees of SOFTWARE made by you in the last 12 months.
CHANGES TO THIS AGREEMENT
We reserve the rights to make changes to this agreement without any prior notice at our sole discretion.
